1.         That the applications be determined in accordance with the recommendations of the of the Development and Conservation Manager subject to the following:

THAT APPLICATION 09/0141/1/PX BE GRANTED SUBJECT TO THE APPLICANTS SIGNED UNILATERAL UNDERTAKING TO SECURE THE FOLLOWING:

1.         Provision of 2 on site affordable housing units (5% of the total number of dwellings to be provided);

2.         The payment of £840 towards Civic Amenity Site infrastructure at Barwell;

4.         The payment of £36,793 for the maintenance and enhancement of off site public open space and recreational facilities;

5.         The payment of £41,013 towards education facilities.

And subject to the imposition of the conditions relating to the following matters:

 

1.         Development to commence within one year

2.         Before commencement materials to be submitted and agreed.

3.         Landscaping to be agreed.

4.         Landscaping scheme to be carried out.

5.         Existing boundary hedgerows to be retained.

6.         Existing trees, etc, to be retained to be protected.

7.         No dwelling occupied until screen fences/walls around plot have been             erected.

8.         Exact position and finished floor levels to be agreed.

9.         First floor windows in plot 33 to be obscurely glazed.

10.       Ground remediation statement to be submitted and agreed.

11.       Ground remediation measures to be carried out.

12.       Foul and surface water drainage to be submitted.

13.       Maximum height of 0.9m for fences, etc, on highway boundary.

14.       No enclosure of car ports.

15.       No surface water drainage onto public highway.

16.       Existing vehicular accesses to be closed within 1 week of the new

           access being used.

17.       Construction vehicle parking to be provided within the site during

           construction works

18.       Off street parking provision.

19.       Drive and turning spaces for dwellings to be surfaced in bound

           material

20.       2m x 2m pedestrian visibility splays to be provided.

21.       Any private drive serving between 5 and 25 dwellings shall have a            

           Minimum width of 4.8m for the first 5 metres.

22.       Only one point of pedestrian access onto Leicester Road.

23.       Details of fencing/wall boundary treatment to Leicester Road frontage

           to be submitted and agreed.

24.       Permission relates to amended plans.

Decision:

DECISION

 

That the Tree Preservation Order made at 55, 57 and 59 Hinckley Road Leicester Forest East (No. 2 ) be confirmed.

 

Reason: Having considered the objections received and balanced them against  the current and future amenity value of the trees located at these addresses, it is considered that there is not sufficient evidence or valid reasons to not confirm the Tree Preservation Order.
