Exempt Information - Exclusion of Members of the Public
The public may be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information.
Resolved - That, under section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A (as amended) to that Act.
To determine the disciplinary appeal of a member of the Regeneration Department.
The Sub-Committee convened to consider the appeal by an employee in the Regeneration Department against the decision of the Director of Regeneration to dismiss him from his current post and relegate him to a lesser post. The appellant was represented by Mr G Bradfield of UNISON.
Resolved - That, having considered carefully all the evidence, the Appeals Sub-Committee upholds the appeal and,
(i) the appellant be reinstated in his post with effect from 10 February, 2009.
(ii) a final written warning, to the effect that if the appellant commits any further act of misconduct or neglect of duty he is liable to be dismissed, remain on the appellant’s record but shall cease to have effect on the expiry of 2 years from the date of the decision letter.
