The Land Charges and Licensing Services Manager submitted a report which informed members of the new application procedures and fees and charges introduced within the Licensing Act 2003.

The Licensing Act 2003 had been amended to make provision for new application procedures effective from 29 July 2009. To accompany these changes the Secretary of State had issued revised guidance under S.182 of the Licensing Act in which it stated that Government recommended that these application decisions should be delegated to licensing officers. Before any of the new applications can be determined, licensing officers require the delegated powers from Council and the delegation scheme contained within the Statement of Licensing Policy requires updating. It is intended that the two officers having delegated powers would be the Land Charges and Licensing Services Manager and the Land Charges and Licensing Officer.

The two new application types were;

• Minor variation of a premises licence/club premises certificate

• Disapplication of Certain Mandatory Conditions For Community Premises

Agreed: - That

a)     The report be noted.

b)     Licensing support the grant of delegated powers to Licensing Officers for the new types of applications in the interests of speed, efficiency and cost effectiveness and to approve the updating of the delegation scheme in the Statement of Licensing Policy accordingly.

The application for a Private Hire Vehicle was withdrawn.

The Senior Land Charges and Licensing Officer submitted a report to consider whether a person who had made an application for the grant of a Hackney Carriage Drivers Badge was a fit and proper person to hold such a licence.

RESOLVED – That the application for the grant of a Hackney Carriage Drivers Badge HCDR/300909/010 be granted.

RESOLVED – That the application for the grant of a Hackney Carriage Drivers Badge HCDR/300909/011 be deferred pending the outcome of the Chief Police Officers enquiries.
