<p class="MsoNormal">Jeremy <span class="SpellE">Appleson</span>,
Deputy Head of Legal Services presented the report which was
prepared under Section 31(2) of the Local Government Act
1974.<span> </span> The report set
out the findings of the Local Government Ombudsman in relation to a
Council Tax debt matter.<span> </span> The Ombudsman has found that the
Council’s actions in obtaining a Bankruptcy Order were
maladministration.<span> </span>
However, the Ombudsman is satisfied with the agreed action taken by
the Council and therefore has made no recommendation with regard to
any further remedy required.<span> </span> This report set out the basis of
the findings for consideration.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">Copies of the full report have been made
available for public inspection in accordance with the provisions
of the Local Government Act 1974 and there has been publicity by
the Council and the Local Government Ombudsman in this
regard.<span> </span></p>
<p class="MsoNormal"> </p>

<p class="MsoNormal">The Mayor in consultation with Cabinet agreed to:</p>

<p class="MsoNormal"> </p>
<p class="MsoNormal">The Council have fully co-operated with an
investigation by the Local Government Ombudsman and reached a
solution to the matters raised which the Ombudsman found
satisfactory.<span> </span> Therefore
whilst there has been a finding of maladministration, which must be
reported to Members in accordance with Section 31(2) of the Local
Government Act 1974, no further action is required.<span> </span> The matter concerns a decision by
the Authority in relation to Council Tax debts due in July
2004.<span> </span> Under Section
31(2) of the 1974 Act the Council is required to consider any
findings of maladministration and to make a decision as to
appropriate action to be taken.<span> </span> As set out in this report the
Ombudsman considers that the Council has already taken satisfactory
action and the purpose of this report is to formally seek Members
approval, under the Act, to the actions taken to resolve this
matter.</p>

Regeneration, Planning and Property, presented a report informing
Members about the corporate Section 106 Review that has been taking
place since July 2008.<span> </span>
This Review has seen the creation of two corporate groups, the Task
Force and the Steering Group, that are undertaking the main bodies
of work in the Review.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">The report also outlines the future of Section
106 management at LBN.<span> </span>
This includes an Action Plan resulting from the lessons learnt from
the Review, and opportunities for Member engagement including
training and regular reporting.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">Some Members were concerned about ensuring
proper consultation takes place, particularly in regard to
children’s services.<span> </span> There was consensus that everyone
who should be consulted is consulted, and this should be
recorded.<span> </span> It was
resolved that there will be a form for all planning applications
with Section 106 agreements consisting of a checklist of
consultees.<span> </span> Members
asked to view the form at a future meeting of Cabinet.</p>

Deputy Head of Legal Services presented the report which was
prepared under Section 31(2) of the Local Government Act
1974.<span style="mso-spacerun:yes"> </span> The report set
out the findings of the Local Government Ombudsman in relation to a
Council Tax debt matter.<span style="mso-spacerun:yes"> </span> The Ombudsman has found that the
Council’s actions in obtaining a Bankruptcy Order were
maladministration.<span style="mso-spacerun:yes"> </span>
However, the Ombudsman is satisfied with the agreed action taken by
the Council and therefore has made no recommendation with regard to
any further remedy required.<span style="mso-spacerun:yes"> </span> This report set out the basis of
the findings for consideration.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">Copies of the full report have been made
available for public inspection in accordance with the provisions
of the Local Government Act 1974 and there has been publicity by
the Council and the Local Government Ombudsman in this

<p class="MsoNormal">The Council have fully co-operated with an
investigation by the Local Government Ombudsman and reached a
solution to the matters raised which the Ombudsman found
satisfactory.<span style="mso-spacerun:yes"> </span> Therefore
whilst there has been a finding of maladministration, which must be
reported to Members in accordance with Section 31(2) of the Local
Government Act 1974, no further action is required.<span style="mso-spacerun:yes"> </span> The matter concerns a decision by
the Authority in relation to Council Tax debts due in July
2004.<span style="mso-spacerun:yes"> </span> Under Section
31(2) of the 1974 Act the Council is required to consider any
findings of maladministration and to make a decision as to
appropriate action to be taken.<span style="mso-spacerun:yes"> </span> As set out in this report the
Ombudsman considers that the Council has already taken satisfactory
action and the purpose of this report is to formally seek Members
approval, under the Act, to the actions taken to resolve this
matter.</p>

Regeneration, Planning and Property, presented a report informing
Members about the corporate Section 106 Review that has been taking
place since July 2008.<span style="mso-spacerun:yes"> </span>
This Review has seen the creation of two corporate groups, the Task
Force and the Steering Group, that are undertaking the main bodies
of work in the Review.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">The report also outlines the future of Section
106 management at LBN.<span style="mso-spacerun:yes"> </span>
This includes an Action Plan resulting from the lessons learnt from
the Review, and opportunities for Member engagement including
training and regular reporting.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">Some Members were concerned about ensuring
proper consultation takes place, particularly in regard to
children’s services.<span style="mso-spacerun:yes"> </span> There was consensus that everyone
who should be consulted is consulted, and this should be
recorded.<span style="mso-spacerun:yes"> </span> It was
resolved that there will be a form for all planning applications
with Section 106 agreements consisting of a checklist of
consultees.<span style="mso-spacerun:yes"> </span> Members
asked to view the form at a future meeting of Cabinet.</p>
