Recordings\nshall be maintained for a period of at least thirty one days and\nmade available to Police and authorised Council officers on\nrequest.

\n\n· \nStaff will be required to\ncomplete the “Refusal Book” if a refusal of alcohol is\nmade. The refusals book\nwill be made available to Authorised Officers of the Council and\nthe Police on request.

\n\n· \nProof of age identification, such as a passport, shall be requested\nof persons appearing to be under the age of 25 to purchase alcohol\nand no sale shall be made unless the customer can produce the\nrequested form of identification.

\n\n· \nEach and every\nindividual item of alcohol to be clearly marked with the name of\nthe premises.

\n\n· \nThat the shop will be laid out in accordance with the plan\nsubmitted with the licence application.
\n\n
\n\n· \nThe premises will display the\nGreenwich “Prove It” and “It’s a\nCrime” Posters.

\n\n· \nNo more than two unaccompanied children will be allowed in the\npremises at any one time.

The Sub\nCommittee’s decision was based on issues raised\nconcerning the\nprevention of crime and disorder, the prevention of public nuisance\nand the protection of children from harm.-

In reaching\ntheir decision the Sub-Committee considered -

The written\nrepresentations from residents, and although none were present to\naddress the Committee due weight was attributed to the\nrepresentations.
\n\n
The\nSub-Committee heard from the applicant’s representative that\nhe currently ran a similar store nearby and was an experienced\nlicensee in respect of measures required to ensure proper\nmanagement of a licensed premises and concerns raised as regards to\nprotection of children from harm. The applicant confirmed it was a\nJunior School and that in the main, children were accompanied by\nparents and where they were not only two would be permitted at any\none time. It was accepted that the alcohol would be displayed as\nper the plan accompanying the application to ensure that at all\ntimes alcohol was visible to the till operator and segregated from\nthe confectionery. The Sub Committee noted that the applicant\ncommitted to move on people who congregated outside of the\nshop.
\n\n
If the\napplicant or person making representations is aggrieved by the\nCouncil’s decision, they may appeal to the Magistrates\nCourt. Such an appeal\nmay be brought within 21 days of receipt of this Notice of\nDecision.

The Chair welcomed the applicant and his\nrepresentative and ensured that introductions were made and all\npapers had been received.

The Sub-Committee considered an application\nmade by Mr Satheeswaran Manmathasingham, of 28 Conway Road, London, SE18\n1AH for the grant of a Premises Licence in respect of “Rhodes\nNews”, 106-108 Bostall Lane, Abby\nWood, London, SE2 0QS.
\n\n
The Team Leader Licensing gave an illustrated\nintroduction to the report.
\n\n
In response to a question from the\nSub-Committee, the Team Leader Licensing clarified that, due to the\nlayout of Bostall Lane, it was not\npossible to see “Rhodes News” from Alexander McLeod\nSchool.
\n\n
The\nSub-Committee was addressed by the Applicant and his\nRepresentative. They said that as a junior school, the majority of\nchildren attending Alexander McLeod School were accompanied by\ntheir parents. Alcohol would be segregated from the confectionery,\nwhich was the area of the shop most likely to be frequented by\nchildren. The shop would be monitored by Closed Circuit Television,\nwhich would help to deter and prevent crime and the applicant would\nmove people along who congregated outside the shop. As a local\nshop, with local customers, it was not anticipated that there would\nbe an increase in traffic in the area as a result of the granting\nof a licence. The applicant currently ran a similar shop in the\narea, which held a premises licence, and had experience in running\na shop of this kind. It was said that the shop represented a\nbenefit to the community, which would be enhanced if it was able to\nsell alcohol. It was noted that there had not been any\nrepresentations from responsible authorities regarding the\napplication.
\n\n
In response to questions from the\nSub-Committee the Applicant and his Representative stated that the\nconditions listed in paragraph 2.3 of the report had been\nvolunteered by the Applicant prior to the meeting to which could be\nadded conditions regarding the segregation of alcohol from\nconfectionery, as well as regarding the moving on of people outside\nof the shop if required. The Applicant lived near to the shop, and\nwould be available to provide appropriate supervision. The\nApplicant and his Representative were not aware of the disorder at\n110 Bostall Lane that had been referred\nto in one of the representations received, but indicated that the\nCCTV that would be installed in the premises would help to provide\na deterrent effect in the area surrounding the premises. The\nApplicant was willing to accept as further conditions
\n\n\n· \nTo operate the “Challenge 25” policy,
\n\n\n· \nTo display the Greenwich “Prove It” and\n“It’s a Crime” posters.
\n\n\n· \nItems of alcohol sold to be clearly marked with the name of the\npremises,
\n\n\n· \nNo more that two unaccompanied children would be allowed in the\npremises at one time.

All parties, with the exception of the Legal\nAdvisor and the Committee Co-ordinators, withdrew to allow the\nSub-Committee to deliberate at 10.27 am. All parties returned at\n10.51 am.

The Sub Committee\nfound that the film contained scenes of moderate violence. The\nmiscarriage scene makes the case for parental attendance. The\nfeaturing of smoking was balanced by the context and not\nglamorised.

The Sub Committee\nnoted that the film lacked subtitling in part and that the\napplicant had undertaken to complete the subtitling and provide a\ncompleted version to the Licensing Authority.
\n\n

The Team\nLeader Licensing advised the\nSub-Committee that the sections of the film that were in the Yoruba\nlanguage had been viewed by an independent Yoruba speaker and\nstated that they did not contain any content which would affect the\nclassification of the film.

The Sub-Committee considered an application\nmade by Mr Abass Tijani representing DJAMEDIA UK, 25 Hollywood Road,\nLondon, E4 8JE for the classification of a film entitled “The\nFigurine (Araromire)”.
\n\n
In response to\nquestions from the Sub-Committee the Applicant replied that the\nversion of the film to be shown would include full subtitles and\nthat a copy of it would be provided to the Licensing Team for their\nrecords. He explained that the audience for the film was expected\nto be primarily people of Nigerian origin. Whilst one of the main\ncharacters did smoke during the film, it was related to the plot\nand the Applicant did not feel that the film glamorised smoking.\nThe Applicant felt that the context and way that the violent scene\nwithin the film was presented did not make it “strong\nviolence”. The Applicant considered that the target audience\nfor the film was primarily over the age of twelve and that the most\nsuitable classification for the film was 12A.
\n\n
All parties, with the exception of the Legal\nAdvisor and the Committee Co-ordinators, withdrew to allow the\nSub-Committee to deliberate at 11.06 am. All parties returned at\n11.20 am.
