In discharging its functions the Sub Committee did so with a view to promoting the licensing objectives of the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm.   Having considered all the evidence put before it the Sub-Committee decided to grant the Premises Licence under the Licensing Act 2003 in respect of the   Rhodes News, 106-108 Bostall Lane SE2   as follows:   That the hours for licensable activities   -        the sale of alcohol shall be   Monday – Saturday 08:00-23:00 hours Sunday 10:00-22:30 Hours     -        the hours that the premises shall be open to the public shall be:   Monday – Saturday 06:00-23:00 hours Sunday 07:00-22:30 Hours     The licence is granted subject to the conditions as are consistent with the Operating Schedule and the conditions volunteered by the applicant as set out below:-   ·              Staff shall be trained in the legal requirements relating to licensing issues.  This training shall be documented and repeated regularly.  The training log shall be made available to Police, the Licensing Authority and Trading Standards team on request.   ·              A fully operational CCTV system shall be provided throughout the public parts of the premises.  The system shall record continuously the whole time the public are on the premises.  Recordings shall be maintained for a period of at least thirty one days and made available to Police and authorised Council officers on request.   ·              Staff will be required to complete the “Refusal Book” if a refusal of alcohol is made.  The refusals book will be made available to Authorised Officers of the Council and the Police on request.   ·              Notices will be displayed asking people to leave quietly.   The licence is also granted subject to the conditions volunteered by the applicant at the meeting, set out as follows:   ·              Proof of age identification, such as a passport, shall be requested of persons appearing to be under the age of 25 to purchase alcohol and no sale shall be made unless the customer can produce the requested form of identification.   ·              Each and every individual item of alcohol to be clearly marked with the name of the premises.   ·              That the shop will be laid out in accordance with the plan submitted with the licence application.   ·              The premises will display the Greenwich “Prove It” and “It’s a Crime” Posters.   ·              No more than two unaccompanied children will be allowed in the premises at any one time.   The licence is granted subject to the Mandatory conditions for sale of alcohol as set out in the Licensing Act 2003 as follows:   1             No supply of alcohol may be made under the Premises Licence –   a)     At a time when there is no Designated Premises Supervisor in respect of the Premises Licence; or b)    At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.   2             Every supply of alcohol under the Premises Licence must be made, or authorised by, a person who holds a Personal Licence.   The Sub Committee’s decision was based on issues raised concerning  the prevention of crime and disorder, the prevention of public nuisance and the protection of children from harm.-   In reaching their decision the Sub-Committee considered -   The written representations from residents, and although none were present to address the Committee due weight was attributed to the representations.   The Sub-Committee heard from the applicant’s representative that he currently ran a similar store nearby and was an experienced licensee in respect of measures required to ensure proper management of a licensed premises and concerns raised as regards to protection of children from harm. The applicant confirmed it was a Junior School and that in the main, children were accompanied by parents and where they were not only two would be permitted at any one time. It was accepted that the alcohol would be displayed as per the plan accompanying the application to ensure that at all times alcohol was visible to the till operator and segregated from the confectionery. The Sub Committee noted that the applicant committed to move on people who congregated outside of the shop.   If the applicant or person making representations is aggrieved by the Council’s decision, they may appeal to the Magistrates Court.  Such an appeal may be brought within 21 days of receipt of this Notice of Decision.   You will be deemed to have received the Decision Notice, two days after the date on the accompanying letter, which will be posted by 1st class mail.   </div> </div> Minutes: <div class="mgWordPara"><div class="Section1"> In Attendance Applicant                                           Satheeswaran Manmathasingham Representative                                   Mr Sriram   The Chair welcomed the applicant and his representative and ensured that introductions were made and all papers had been received.   The Sub-Committee considered an application made by Mr Satheeswaran Manmathasingham, of 28 Conway Road, London, SE18 1AH for the grant of a Premises Licence in respect of “Rhodes News”, 106-108 Bostall Lane, Abby Wood, London, SE2 0QS.   The Team Leader Licensing gave an illustrated introduction to the report.   In response to a question from the Sub-Committee, the Team Leader Licensing clarified that, due to the layout of Bostall Lane, it was not possible to see “Rhodes News” from Alexander McLeod School.   The Sub-Committee was addressed by the Applicant and his Representative. They said that as a junior school, the majority of children attending Alexander McLeod School were accompanied by their parents. Alcohol would be segregated from the confectionery, which was the area of the shop most likely to be frequented by children. The shop would be monitored by Closed Circuit Television, which would help to deter and prevent crime and the applicant would move people along who congregated outside the shop. As a local shop, with local customers, it was not anticipated that there would be an increase in traffic in the area as a result of the granting of a licence. The applicant currently ran a similar shop in the area, which held a premises licence, and had experience in running a shop of this kind. It was said that the shop represented a benefit to the community, which would be enhanced if it was able to sell alcohol. It was noted that there had not been any representations from responsible authorities regarding the application.   In response to questions from the Sub-Committee the Applicant and his Representative stated that the conditions listed in paragraph 2.3 of the report had been volunteered by the Applicant prior to the meeting to which could be added conditions regarding the segregation of alcohol from confectionery, as well as regarding the moving on of people outside of the shop if required. The Applicant lived near to the shop, and would be available to provide appropriate supervision. The Applicant and his Representative were not aware of the disorder at 110 Bostall Lane that had been referred to in one of the representations received, but indicated that the CCTV that would be installed in the premises would help to provide a deterrent effect in the area surrounding the premises. The Applicant was willing to accept as further conditions ·              To operate the “Challenge 25” policy, ·              To display the Greenwich “Prove It” and “It’s a Crime” posters. ·              Items of alcohol sold to be clearly marked with the name of the premises, ·              No more that two unaccompanied children would be allowed in the premises at one time.   All parties, with the exception of the Legal Advisor and the Committee Co-ordinators, withdrew to allow the Sub-Committee to deliberate at 10.27 am. All parties returned at 10.51 am.   The Chair read out the decision.   In reaching its decision the Sub Committee considered the Council’s statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under S.182 of that Act. The miscarriage scene makes the case for parental attendance. The featuring of smoking was balanced by the context and not glamorised.   The Sub Committee noted that the film lacked subtitling in part and that the applicant had undertaken to complete the subtitling and provide a completed version to the Licensing Authority.   A copy of the decision notice will be despatched within 5 working days. Details of the classification will also be published on the following website www.greenwich.gov.uk.   </div> </div> Minutes: <div class="mgWordPara"><div class="Section1"> In Attendance Applicant                                           Abass Tijani   The Chair welcomed all parties and asked Members to confirm that they had viewed the film.  Members confirmed that they had viewed the film.   The Team Leader Licensing advised the Sub-Committee that the sections of the film that were in the Yoruba language had been viewed by an independent Yoruba speaker and stated that they did not contain any content which would affect the classification of the film.   The Sub-Committee considered an application made by Mr Abass Tijani representing DJAMEDIA UK, 25 Hollywood Road, London, E4 8JE for the classification of a film entitled “The Figurine (Araromire)”.   In response to questions from the Sub-Committee the Applicant replied that the version of the film to be shown would include full subtitles and that a copy of it would be provided to the Licensing Team for their records. He explained that the audience for the film was expected to be primarily people of Nigerian origin. Whilst one of the main characters did smoke during the film, it was related to the plot and the Applicant did not feel that the film glamorised smoking. The Applicant felt that the context and way that the violent scene within the film was presented did not make it “strong violence”. The Applicant considered that the target audience for the film was primarily over the age of twelve and that the most suitable classification for the film was 12A.   All parties, with the exception of the Legal Advisor and the Committee Co-ordinators, withdrew to allow the Sub-Committee to deliberate at 11.06 am. All parties returned at 11.20 am.   The Chair read out the decision.   In reaching its decision the Sub Committee considered the Council’s statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under S.182 of that Act.
