(52)2511 or e-mail  <a href="mailto:avalentine@aberdeencity.gov.uk" class="external">avalentine@aberdeencity.gov.uk</a>  Items No. Item <a name="AI3397"></a>1. 288 NORTH DEESIDE ROAD, CULTS - REPLACEMENT DWELLINGHOUSES Minutes: <div class="mgWordPara"><div class="Section1"> ABERDEEN, 22nd April, 2009.  -  Minute of Meeting of the PLANNING APPEALS PANEL of ABERDEEN CITY PLANNING COMMITTEE.  Present:-  Councillor Cassie, Convener;  and Councillors Clark, Collie, Farquharson (substituting for Councillor Milne) and Jaffrey.                   EXEMPT INFORMATION               Before proceeding to consider the business before it, the Panel resolved in terms of Section 50A(4) of the Local Government (Scotland) Act 1973, to exclude the public from the meeting on the ground that it was likely, in view of the nature of the business to be transacted, that if the public were in attendance during consideration thereof, there would be disclosure to them of exempt information as defined in paragraph 12 of Schedule 7(A) to the said Act.     APPEAL   The Panel had under consideration, intimation from the City Solicitor that the application (A8/0913) for planning permission to erect two semi-detached replacement dwellinghouses on the site of the existing property at 288 North Deeside Road, Cults, which would be demolished, was now the subject of an appeal to the Scottish Ministers.  The application had been refused by the Council at its meeting on 25th March, 2009 (Article 13) for the following reasons:-  (1) the development if approved would involve the loss of a traditional granite building which although not listed was one of the earliest examples of such a building in the Cults/Bieldside area, the replacement of which with a larger building finished on two elevations with dry dash render, would be seriously detrimental to the general character and appearance of the surrounding area;  and (2) the replacement building proposed, because of its scale and massing, would have a detrimental impact on the residential amenity of the neighbouring property at 290 North Deeside Road, Cults.   The Panel at this point were advised by the Council’s Legal Manager that the appeal was to be determined using the written submissions process.  The Panel were also advised of the applicants intention to seek to recover the costs of the appeal from the Council on the ground that the decision to refuse the application had been unreasonable.  The detailed grounds of appeal were circulated to members and discussed in the context of the reasons for refusal of the application.   The Panel resolved:- that the appeal be resisted and it be remitted to the City Solicitor to attend to the Council’s interests in the matter. - SCOTT CASSIE, Convener. </div> </div> <div class="mgHelpLine"> </div> </div> 2009-12-01T21:06:27+00:00
