To consider a report by the Licensing Manager\n(Reference 09/167) attached. (This report seeks the\ndetermination by the Licensing Sub-Committee of an application for\na Premises Licence where relevant representations have been\nreceived.)

The Sub-Committee considered a report of the\nLicensing Manager (Reference 09/167).

\n

RESOLVED that the application for a\npremises licence for Blue Crush Ltd, The Sands, Peasholme Gap, Scarborough, YO12 7TN be granted\nsubject to the following conditions:-

\n

To grant the licence with\nthe following conditions:

\n

\na.        \nAll conditions consistent with the Operating Schedule (see\nbelow)

\n

\nb.        \nAll drinking vessels shall be polycarbonate

\n

\nc.        \nSales and supply of alcohol shall be restricted to 11:00am to 23:00 every day

\n

\nd.        \nAll drinks that are to be consumed in the outside seating area\nshall be ordered within the building and shall be served outside by\nwaitress service only

\n

\ne.        \nAll deliveries shall be made between 08:00 to 17:00

\n

\nf.         \nAll performances of live music shall be restricted to 12:00 to\n20:00

\n

\nThe Operating Schedule

\n

1.        \nThere shall be no drinks promotions.

\n

\n2.        \nThe business shall operate as a family eating venue and not a\ndrinking venue.

\n

\n3.        \nCCTV shall be installed to cover all\nareas including the external seating area.

\n

4.        \nThe premises shall participate in the Pubwatch scheme.

\n

\n5.        \nThere shall be no standing alcohol consumption areas.  All customers shall be\nseated with a waiting on service.

\n

\n6.        \nA notice shall be displayed requesting customers to leave the\npremises quietly.

\n

7.        \nThe premises shall close at midnight.

\n

8.        \nThe volume of music shall be lowered 30 minutes prior to\nclosure.

\n

\n9.        \nThe occupancy of the premises shall be determined by the seating\ncapacity.

\n

10.       There\nshall be no standing areas.

\n

11.       Tap\nwater shall be freely available.

\n

12.       Empty\nglasses shall be removed from tables when a table is vacated.

\n

\n13.       All\ndeliveries shall be within working hours and shall be to the rear\nof the premises.

\n

\n14.       All\ndrink related incidents shall be recorded in the premises logbook\nand North Yorkshire Police shall be informed of each incident.

\n

\n15.       The\n“Challenge 21” policy shall be adopted and appropriate\nposters shall be displayed.

\n

\n16.      \nAlcohol shall only be purchased for personal\nconsumption.  Any\nbreaches of this shall be recorded in the premises logbook and\nreported to North Yorkshire Police.

\n

\n17.       All\nchildren must be accompanied by an adult and all purchases shall be\nmade by an adult.

\n

\n18.      \nChildren’s parties shall be held in a private room on the\nmezzanine floor.

\n

19.       All\nparties shall be supervised by a member of staff.

\n

Members’ Reasons

\n

The Sub-Committee found that in order to\nsecure compliance with the identified licensing objectives and in\nparticular the prevention of noise and nuisance affecting residents\nof the flats within the building the above conditions were\nnecessary.

\n

In coming to this decision the Sub-Committee\nhas considered the application on its own merit but has had due\nregard to the National Guidance issued under Section 182 of the Licensing Act 2003 and\nScarborough Borough Council’s Licensing Policy.  Your Premises Licence will follow\nin due course.
