The Interim Service Director, Legal and Democratic Services submitted a report which provided an update on current issues in Private Hire and Hackney Carriage Licensing together with relevant statistics.

 

The appendix attached to the report included information on vehicles, drivers and operators/proprietors together with information on enforcement matters within the Licensing Section.  Details on Private Hire and Hackney Carriage Medical Standards had also been included for information.

 

Resolved – That the report be noted.

Appeals to the Courts Against Committee Decisions

Minutes:

Consideration was given to a report of the Interim Service Director, Legal and Democratic Services which provided the Committee with details of recent court judgements in respect of three appeals brought against the Committee’s decisions.  The first appeal was in relation to the Committee’s decision to renew a Private Hire Drivers’ Licence and then suspending it for three months.  The second appeal was in relation to the Committee’s decision not to renew a Private Hire Drivers’ licence and the third was from an aggrieved applicant for a Private Hire Drivers’ Licence whose application had been refused by the Committee.

 

Resolved - That the Magistrates Court judgement, and the fact that one appeal was upheld and that two were dismissed, be noted.

The Committee gave consideration to an application for a Private Hire Drivers’ Licence following the Registration and Licensing Manager’s indication to the applicant in a letter dated 26 November 2009 that she had concerns regarding the application.  The Applicant was in attendance at the meeting to explain why the application should be granted.

 

Resolved – That the application for a Private Hire Drivers’ Licence, reference R/584010/PS, be granted for 6 months.

 

Reason – Having regard to the information before them, the Committee were satisfied that the Applicant was a fit and proper person to hold a Private Hire Driver’s Licence.

The Committee gave consideration to an application for a Private Hire Drivers’ Licence following the Registration and Licensing Manager’s indication to the applicant in a letter dated 26 November 2009 that she had concerns regarding the application.  The Applicant and his representative were in attendance at the meeting to explain why the application should be granted.

 

Resolved – That the application for a Private Hire Drivers’ Licence, reference K/082122/MS, be refused.

 

Reason – Having regard to the information before them, the Committee could not be satisfied that the Applicant was a fit and proper person to hold a Private Hire Drivers’ Licence.

Resolved – That Private Hire Drivers’ Licence, reference A/187072/I, be revoked.

 

Reason – Having regard to the information before them, the Committee could not be satisfied that the Licence Holder remained a fit and proper person to hold a Private Hire Drivers’ Licence.

Reason – Having regard to the information before them and the Licence Holders explanation, the Committee remained satisfied that the Licence Holder was a fit and proper person to hold a Private Hire Drivers’ Licence.

The Committee considered an application to renew a Hackney Carriage Drivers’ Licence following the Registration and Licensing Manager’s indication to the applicant in a letter dated 26 November 2009 that she had concerns regarding the application.  The Applicant was in attendance at the meeting to explain why the renewal should be granted.

 

Resolved – That the renewal application for a Hackney Carriage Drivers’ Licence, reference A/777080/Z, be granted, but that the new licence be suspended for a period of 3 weeks.

 

Reason – Having regards to the information before the Committee and to give the applicant time to reflect on his actions.

Resolved – That the renewal application for a Private Hire Driver’s Licence, reference S/078072/SIH, be granted.

 

Reason – Having regard to the Applicant’s explanation of his previous convictions, the Committee were satisfied that the Applicant was a fit and proper person to hold a Private Hire Drivers’ Licence.
