This related to two types of appeals as\nfollows:-</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"margin-left:.5in;text-indent:-.5in;mso-list:l0 level3 lfo1; tab-stops:list .5in;mso-layout-grid-align:none;text-autospace:none\">\n<span style=\"font-family:Symbol\">&middot;<span style=\"font:7.0pt \\\"Times New Roman\\\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span>\nAppeals over the failure to grant planning permission for the\nunlawful development; and</p>\n<p class=\"MsoNormal\" style=\"margin-left:.5in;text-indent:-.5in;mso-list:l0 level3 lfo1; tab-stops:list .5in;mso-layout-grid-align:none;text-autospace:none\">\n<span style=\"font-family:Symbol\">&middot;<span style=\"font:7.0pt \\\"Times New Roman\\\"\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span>\nAppeals over the issuing of an Enforcement Notice in relation to\nthe unlawful development.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">Under UK planning\nlaw, carrying out unlawful development did not automatically lead\nto prosecution. The Council had to determine what was done in the\nfirst instance and then decide whether it was prudent to issue an\nEnforcement Notice. Failure to comply with the Enforcement Notice\ncould lead to prosecution and penalties but the person first had\nthe opportunity to appeal.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">Frequently, the\nperson involved would also lodge an application retrospectively,\nfor planning permission to legalise the situation. If planning\npermission was refused the applicant had the opportunity to appeal\nthe decision.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">Prosecutions were\ntherefore normally pursued only following an extensive period\nduring which the applicant had exhausted all appeal rights. A list\nof ten pending prosecutions was provided in appendix 1.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">Members expressed\nconcern about the length of time that expired before enforcement\nwas commenced in cases where applications were refused and felt\nthat steps towards enforcement and litigation should be instituted\nimmediately after an application was refused.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">Members also\ncommented on the apparent co-ordination issues that existed between\nPlanning, Enforcement and Licensing.</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\">&nbsp;</p>\n<p class=\"MsoNormal\" style=\"mso-layout-grid-align:none;text-autospace:none\"><b>Resolved:</b>\nThat (i) we note the contents of the report before us as well as\nthe comments made by Members thereon;
