This related to two types of appeals as follows:-   ·                    Appeals over the failure to grant planning permission for the unlawful development; and ·                    Appeals over the issuing of an Enforcement Notice in relation to the unlawful development.   Under UK planning law, carrying out unlawful development did not automatically lead to prosecution. The Council had to determine what was done in the first instance and then decide whether it was prudent to issue an Enforcement Notice. Failure to comply with the Enforcement Notice could lead to prosecution and penalties but the person first had the opportunity to appeal.   Frequently, the person involved would also lodge an application retrospectively, for planning permission to legalise the situation. If planning permission was refused the applicant had the opportunity to appeal the decision.   Prosecutions were therefore normally pursued only following an extensive period during which the applicant had exhausted all appeal rights.
