Minutes:

The minutes of the previous meeting, held on 20th January 2010, were confirmed and signed by the Chairman as a true and correct record of the proceedings.

Chairman's Announcements

Minutes:

The Chairman reported that Councillor Jennie Kelly was progressing well following her recent period of ill health. Councillor Mrs Sheila Young MBE had broken her ankle, a get well card was circulating for Members to sign.

 

At the invitation of the Chairman, the Development Control Manager provided the following updates:

 

Planning Enforcement Officer, Ben Greenaway, had suffered a sports related injury meaning he will be absent from work for up to a period of up to 3 months. On a more positive note, it was hoped that Natalie Jones, an officer with previous experience in this area of work, would be joining the team on a 12 month fixed term contract in the next few weeks.

 

Development Control were hoping to move from Portland House back to Brunel House in the next 2 to 3 weeks, the moving process would mean officers would be out of circulation, but returning to Brunel House would make officers more accessible to Members.

Development Control Performance Statistics - to be reported at the meeting

Minutes:

The development control performance figures for January and February 2010 were reported:

January 2010 were 51% overall, major planning applications 50%, minor planning applications 47%, other planning applications 52%. 

The Year to Date development control performance figures were major planning applications 76%, minor planning applications 78%, other planning applications 83%.

During January 2010 11 enforcement cases had been received, 12 had been considered and closed and therefore 141 remained on hand.

 

February 2010 were 44% overall, major planning applications 60%, minor planning applications 60%, other planning applications 39%. 

The Year to Date development control performance figures were major planning applications 74%, minor planning applications 74%, other planning applications 77%.

During January 2010 14 enforcement cases had been received, 6 had been considered and closed and therefore 149 remained on hand.

33 No. Category II sheltered apartments for the elderly, communal facilities, car parking, access and landscaping; relocation of public convenience block and electricity sub station at Land At Junction Of Worcester Road, Howsell Road, Malvern for Churchill Retirement Living Ltd.

 

Recommendation: that the Head of Planning & Housing Services be authorised to GRANT planning permission 09/00753/FUL subject to the applicant entering into a Section 106 Legal Agreement requiring that the development is constructed to provide a weather tight core and shell within 18 months of the date of the decision notice granting planning permission, with failure to achieve this resulting in a requirement on the part of the applicant/site owner to further submit an up to date viability appraisal in respect of the provision of on site, or a payment towards off site affordable housing and public open space provision (in accordance with current Policy requirements) and if the viability has improved sufficiently then S106 contributions to be paid to the Local Planning Authority.

 

 

 

An additional representation was received and an additional condition recommended.

Erection of 4 no. detached dwellings and detached garages together with associated road and sewer infrastructure works at Sunnymead, Gloucester Road, Welland for Mr G Whittall.

 

Original Recommendation: that planning permission be delegated to the Head of Planning and Housing to GRANT planning permission, subject to the applicant entering into a Section 106 Legal Agreement in respect of the payment of a financial contribution towards off site affordable housing provision.

 

Amended Recommendation: Delegated to the Head of Planning and Housing to GRANT Planning Permission subject to the receipt of foul and surface water drainage details, incorporating sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development.

 

 

 

 

Additional representations and officer comment were received, amended conditions were recommended in respect of plan nos and amended sustainable drainage condition and an amended recommendation received.

 

Mr Roger Cousins, Chairman of Little Malvern & Welland Parish Council, addressed the Committee under the public speaking scheme.

 

Mr Stephen Salisbury, on behalf of the applicant, addressed the Committee under the public speaking scheme.

 

 

DEFERRED in order for the submission of amended plans increasing the width of / providing a passing bay along the access drive, and further investigations into the surface water drainage of the site.

Recommendation: that planning permission be delegated to the Head of Planning and Housing to Grant Planning Permission subject to no adverse comments being received from Natural England, and the applicant entering into a Section 106 Legal Agreement in respect of a payment to off site public open space and to ensure that the affordable housing units remain affordable in perpetuity.
