\nMembers are asked to\nconsider any Personal/Prejudicial Interests they may have to\ndisclose to the meeting in relation to matters under consideration\non the agenda. If the\npersonal interest is a prejudicial interest, then the individual\nmembers should not participate in a discussion on the matter and\nmust withdraw from the meeting room and must not seek to improperly\ninfluence a decision in the matter.

\nThe Corporate Director\nEnvironment presented a report giving details of an application for\nthe grant of a premises licence in respect of 24 Fishergate Hill, Preston.
\n\n
Representations were\nreceived from Lancashire Constabulary and three interested\nparties.
\n\n
One interested party had\nsubmitted a regulation 8 notice indicating that they did not intend\nto attend the hearing. Two of the interested parties had failed to\nindicate whether they intended to be present or represented at the\nhearing. The Licensing Sub-Committee agreed under Regulation 20 of\nthe Licensing Act 2003 (Hearings) Regulations 2005 to proceed in\ntheir absence.
\n\n
(At this point Councillor Crompton declared a\nprejudicial interest in the matter insofar as the applicant\nrecognised him as an acquaintance and withdrew from the hearing,\ntaking no part in proceedings therein. The hearing proceeded with a\nsub committee quorate of two\nmembers).
\n\n
Lancashire Constabulary\nmade representations to the sub-committee.
\n\n
The sub-committee\nretired to consider its decision in accordance with the agreed\nprocedure.
\n\n
Resolved\n– That the application be granted subject to the\nfollowing conditions and hours:-
\n\n
1. \nConditions consistent with the Operating Schedule, save for those relating to CCTV, training of staff and the adoption of the\nchallenge 21 policy which shall be the form of wording set out\nbelow.
\n\n
2. \nThe premises shall have in place a written ‘check 21’\npolicy. This policy\nshall be actively promoted and state that any person to which the\nsale or supply of alcohol is being made, who looks or appears to be\nunder 21 years of age shall be asked to provide identification that\nthey are 18 years of age or over. The following are the only forms\nof identification acceptable:
\n\n
\na) \nPassport
\n\nb) \nPhoto driving licence
\n\nc) \nPass accredited holographic proof of age card
\nd) \nAny other form of identification agreed with Preston Police\nLicensing Unit.
\n\n
3. \nSigns promoting this policy shall be prominently displayed at the\npublic entrance and alcohol sales area.
\n\n
4. \nAll staff members will receive training in relation to age related\nsales, ‘check 21’ policy and the provisions of the\nLicensing Act 2003. \nRecords of this training will be kept on the premises and produced\nto the police, Trading Standards or Local Authority enforcement\nofficers on request.
\n\n
5. \nThe premises will be equipped with a CCTV system that shall meet the following\ncriteria:
\n\n
a) \nThe system shall comprehensively cover the public areas of the\npremises.
\nb) \nThe system shall capture a clear head and shoulders view of persons\nentering the premises.
\nc) \nThe system shall be maintained in proper working order.
\nd) \nThe system shall display on any recording the correct time and date\nof the recording.
\ne) \nThe system shall be recording during all times the\npremises is open to the public.
\nf) \nThe recorded VCR tapes or\ndigital recording media shall be held for a minimum of 31 days\nafter the recording is made and shall be made available to the\npolice for inspection on request.
\ng) \nOn request from the police CCTV footage\nwill be provided to them on removable media within 24\nhours.
\nh) \nCCTV signage should accompany the\nsystem both externally and internally to the building. An A4 size advisory sign\nindicating that CCTV is in operation in\nthe premise should be displayed on the outside of the building at\nthe main entrance and inside the premises.

6. \nNo alcohol shall be sold in an unsealed container.
\n\n
7. \nNotices will be displayed at the entrance to the premises, at the\ncheck out and on the alcohol displays to indicate that it is\nunlawful for persons under 18 to purchase alcohol or for any person\nto purchase alcohol on behalf of a person under 18 years of age.
\n\n
8. \nWhenever a Personal Licence holder is not at the premises, another\nindividual must be nominated as being the responsible person\nnominated by the Personal Licence holder to manage the premises and\nthey must have the contact details of the Designated Premises\nSupervisor.
\n\n
9. \nNo personal in possession of an alcoholic drink in a sealed or\nunsealed container shall be allowed to enter the premises except\nfor the purposes of delivery.
\n\n
10. The\nmandatory conditions set out in the Licensing Act 2003.
\n\n
The hours in respect of\nthe supply of alcohol will be Monday to Sunday from\n8.00am to 8.00pm (daily).
