Two of the interested parties had failed to indicate whether they intended to be present or represented at the hearing. The Licensing Sub-Committee agreed under Regulation 20 of the Licensing Act 2003 (Hearings) Regulations 2005 to proceed in their absence.   (At this point Councillor Crompton declared a prejudicial interest in the matter insofar as the applicant recognised him as an acquaintance and withdrew from the hearing, taking no part in proceedings therein. The hearing proceeded with a sub committee quorate of two members).   Lancashire Constabulary made representations to the sub-committee.   The sub-committee retired to consider its decision in accordance with the agreed procedure.   Resolved – That the application be granted subject to the following conditions and hours:-   1.         Conditions consistent with the Operating Schedule, save for those relating to CCTV, training of staff and the adoption of the challenge 21 policy which shall be the form of wording set out below.   2.         The premises shall have in place a written ‘check 21’ policy.  This policy shall be actively promoted and state that any person to which the sale or supply of alcohol is being made, who looks or appears to be under 21 years of age shall be asked to provide identification that they are 18 years of age or over.  The following are the only forms of identification acceptable:               a)         Passport             b)         Photo driving licence             c)         Pass accredited holographic proof of age card d)         Any other form of identification agreed with Preston Police Licensing Unit.   3.         Signs promoting this policy shall be prominently displayed at the public entrance and alcohol sales area.   4.         All staff members will receive training in relation to age related sales, ‘check 21’ policy and the provisions of the Licensing Act 2003.  Records of this training will be kept on the premises and produced to the police, Trading Standards or Local Authority enforcement officers on request.   5.         The premises will be equipped with a CCTV system that shall meet the following criteria:   a)         The system shall comprehensively cover the public areas of the premises. b)         The system shall capture a clear head and shoulders view of persons entering the premises. c)         The system shall be maintained in proper working order. d)         The system shall display on any recording the correct time and date of the recording. e)         The system shall be recording  during all times the premises is open to the public. f)          The recorded VCR tapes or digital recording media shall be held for a minimum of 31 days after the recording is made and shall be made available to the police for inspection on request. g)         On request from the police CCTV footage will be provided to them on removable media within 24 hours. h)         CCTV signage should accompany the system both externally and internally to the building.  An A4 size advisory sign indicating that CCTV is in operation in the premise should be displayed on the outside of the building at the main entrance and inside the premises.   6.         No alcohol shall be sold in an unsealed container.   7.         Notices will be displayed at the entrance to the premises, at the check out and on the alcohol displays to indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.   8.         Whenever a Personal Licence holder is not at the premises, another individual must be nominated as being the responsible person nominated by the Personal Licence holder to manage the premises and they must have the contact details of the Designated Premises Supervisor.   9.         No personal in possession of an alcoholic drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery.   10.       The mandatory conditions set out in the Licensing Act 2003.   The hours in respect of the supply of alcohol will be Monday to Sunday from 8.00am to 8.00pm (daily).         </div> </div> <div class="mgHelpLine"> </div> </div> 2010-03-22T12:49:31+00:00
