An application was received on the 28th April 2010 and a Public Notice had been displayed and advertised in the local press as required by the Licensing Act 2003. Â The Fire Authority made no representation. Â The Planning Officer made no representation. Â The Hertfordshire Constabulary made one representation to this application. Â The Environment and Health Officer made no representation for this application. Â 9 interested parties made a representation but only 1 was deemed to be in the vicinity. Â The following licensable activities have been applied for on the premises licence application form: Â Supply of Alcohol 06.00 to 00.00 Monday to Sunday. Â Hours Premises are Open to the Public: 06.00 to 00.00 Monday to Sunday Â The Licensing Solicitor gave legal advice throughout the hearing. We have considered the representations from the interested parties to be outside of the vicinity of the premises apart from Harrison Murray which was deemed in the vicinity.Â In considering the question of vicinity we noted the nature of the location of the premises, with numerous licensed businesses in the same area, so that it is difficult to ascertain that these premises would have a direct affect on those making representations. We have considered the representations from the interested parties to be outside of the vicinity of the premises apart from Harrison Murray which was deemed in the vicinity.  In considering the question of vicinity we noted the nature of the location of the premises, with numerous licensed businesses in the same area, so that it is difficult to ascertain that these premises would have a direct affect on those making representations.       The Sub Committee granted the application as follows:   Opening hours to the public:   Monday – Sunday:   06:00 – 23:00   Sale of Alcohol:   Monday – Sunday: 08:00 – 23:00   CONDITIONS:   Prevention of Crime and Disorder:   1.  The Premises Licence Holder and the Designated Premises Supervisor shall ensure that the premises are equipped with a digital closed circuit television system, compatible with the requirement of the Hertfordshire Constabulary.  The recordings of which will be made to a digital hard drive and retained for a minimum of 31 days.  The recordings of the CCTV will be made available to Hertfordshire Constabulary, Local Authority Licensing Officer or Trading Standards Officer, subject to the Data Protection Act.  These recordings (including playback software) will be burnt to either a CDR or DVDR and be able to play instantly on a Personal Computer or a DVD player. No USB, Memory sticks, SD cards or similar will be used (these are not compatible with Hertfordshire Constabulary computer systems).  There will be at least one staff member on duty at all times (when the premises is open) who is trained to use the CCTV system.  Hertfordshire Constabulary with the Local Authority Licensing Officer will be notified (within 5 days) on any occasion when the premises CCTV system is inoperative.   2.  The Premises Licence Holder shall keep a register / book of ‘sales of alcohol refused’.  This register will be kept on the premise at all times and will be made available to Hertfordshire Constabulary (including Police Community Support Officers), Local Authority Licensing Officer and Trading Standards Officer upon request.   3.  The Premises Licence Holder or a member or staff shall ensure that identification is provided by every person buying alcohol that appears to be under 21 years of age.  The only acceptable forms of identification are a valid Passport or Photo card-driving licence, as per local authority policy.  No photocopies will be accepted.   4.  The Premises Licence Holder will ensure that there is a Personal Licence Holder on the premises between 19:00hrs – closing on Thursday, Friday, Saturday and Sundays.   5.  Before every sale of alcohol between 19:00 – 23:00 on Thursday, Friday, Saturday and Sundays the purchaser (of alcohol) must be reminded that they must not be purchasing alcohol for the consumption of persons less than 18 years of age.   6.  The premises will display clear and visible signage at all times reminding customers that is an offence alcohol for persons less than 18 years of age or persons who are drunk.   7.  Every container of alcohol that is sold from the premises will display a sticker with the premises name.   8.  The Premises Licence Holder / Designated Premises Supervisor will ensure that all staff are suitably and regularly trained and authorised to sell alcohol.  Records of this training will be kept on the premises.  These records will be made available to Hertfordshire Constabulary (including Police Community Support Officers), Local Authority Licensing Officer and Trading Standards Officer upon request.      Prevention of Public Nuisance:   1.  Mr Patel ensures that all staff undertake appropriate courses on responsible retailing and a record of this is available on the premises at all times in accordance with the aims of responsible retailing.     REASONS FOR DECISION   1.  With the conditions as outlined and the reduced hours for the sale of alcohol.
