There shall be no commencement of the development hereby permitted until the proposed vehicular access has been constructed to the specification of the Highway Authority and to the satisfaction of the Local Highway Authority.   7.  There shall be no commencement of the development hereby permitted until a visibility splay of 4.5m x 90m is provided to the south of the proposed access as shown on drawing SK01 REV C. 4.5m shall be measured along the centreline of the proposed access from the western edge of the B651 carriageway and 90m is measured from the centreline of the proposed access southwards along the B651 carriageway edge. The area contained within the splays shall be maintained free of obstruction exceeding 1.0 metres in height above the nearside channel level of the B651 carriageway.   8.  There shall be no commencement of the development hereby permitted until a visibility splay of 4.5m x 120m is provided to the north of the proposed access shown on drawing SK01 REV C. 4.5m shall be measured along the centreline of the proposed access from the western edge of the B651 carriageway and 120m is measured from the centreline of the proposed access northwards along the B651 carriageway edge. The area contained within the splays shall be maintained free of obstruction exceeding 1.0 metres in height above the nearside channel level of the B651 carriageway.   9.  There shall be no beneficial use of the proposed vehicular access shown in drawing SK01REV C until said access has been constructed of bound materials and to the satisfaction of the Local Highway Authority.   10.  Notwithstanding the details shown on drawing SK01/REV C, prior to commencement of the development hereby approved there shall be submitted to and approved in writing by the local planning authority, details of the flow control plates and gate arrangement at the approved highway access point. The development shall thereafter be carried out in accordance with the approved details.   11.  Prior to the use of access road and car park, a Management Plan shall be submitted to and approved in writing by the Local Planning Authority providing details of and expanding upon the site security / protection, management and maintenance strategy set out in Section 7 of the approved Design & Access Statement. The Plan shall include details of access points, control of the site to prevent overnight use, control of the use of the overspill car park, and the use of wardens to monitor the site The management of the site shall thereafter be carried out in accordance with the approved Plan.   12.  No demolition or construction works relating to this permission shall be carried out on any Sunday or Bank Holiday nor before 07.30 hours or after 18.00 hours on any days nor on any Saturday before 08.00 hours or after 13.00 hours.   13.  No external loudspeaker systems shall be installed without the prior approval in writing of the Local Planning Authority.   14.  This permission does not extend to the installation of external lighting.  A scheme for any such works would require a separate application for planning permission to the Local Planning Authority.   (ii)  That in an informative note issued pursuant to Department of the Environment Circular 11/95 the applicant be informed of the following matters:   1.  The applicant is respectfully reminded that they are not authorised to undertake works on or in highway and Rights of Way. The Highway Authority require the alterations to the vehicle access to be undertaken such that the works are carried out to their specification and by a contractor who is authorised to work in the public highway. The applicant will need to apply to the Mid West Hertfordshire Highways Area Office (Telephone 01727 816000) to arrange this.   2.  This determination was based on the following drawings and information: Drawing No.'s / Titled Location Plan, Red Line, 001/P1, 002/P1, SK01/REV C, Proposed Car Parking Sketch Design Section 1 of 2, Proposed Car Parking Sketch Design Section 2 of 2, Design and Access Statement and Transport Statement, received 12 Mar 2010.   3.  The applicants are advised that there may be habitats or species of conservation concern listed in the UK Biodiversity Action Plan (1994) or species protected by UK or European legislation on site or nearby likely to be affected by the development proposed.   Under the Wildlife and Countryside Act 1981 (as amended); birds are protected under Schedule 1, other animals in Hertfordshire (bats, dormice, otter, water vole, great crested newt, adder, grass snake, slow worm, common lizard plus some invertebrates) are protected under Schedule 5 and plants are protected under Schedule 8.  In the UK, badgers are protected under the Protection of Badgers Act (1992).   Some of the above species are also protected under the Conservation (Natural Habitats & c.) Regulations 1994 which defines 'European protected species of animals.  These include all bat species, dormice, otter and great crested newt.  Where European protected species are present on a site a Habitat Regulations Licence will be required from the Department of Environment, Food and Rural Affairs (DEFRA) before any works can commence on the development.  A Habitat Regulations Licence will only be issued if the applicant can demonstrate that: the development is in the interests of public health and safety or other imperative reasons of overriding public interest including those of a social and economic nature, there is no satisfactory alternative and the development will not be detrimental to the maintenance of the population of the species at a favourable conservation status in their natural range.     For information on species and habitats of importance please contact the Hertfordshire Biological Records Centre, c/o Environment, Hertfordshire County Council, County Hall, Pegs Lane, Hertford, SG13 8DN Tel: 01992 555220 for further advice and assistance.     4.  The attention of the applicant is drawn to the Control of Pollution Act 1974 relating to the control of noise on construction and demolition sites.   5.  The applicant is advised that the development will affect a definitive footpath and the Footpaths Officer, Hertfordshire County Council should be contacted in this matter. The applicant may need to make temporary provision for access as part of the construction of the vehicular access point.   6.  The applicant should provide details of the litter management and barrier management as part of the Management Plan referred to in Condition 11 above.   Reason for Grant   The principle of the car park is considered to be acceptable, taking into account its relationship with the wider provision of Heartwood Forest. Overall, the visual impact of the car park will be acceptable, and the proposal will result in improvements to landscaping and local habitat provision. There will be no harmful adverse impact on the amenities of adjoining residents and the proposal will not result in any detriment to the free and safe flow of highway users. Subject to a condition, there will be no adverse impact on potential archaeological assets. The proposal is in accordance with Policies 1 (Metropolitan Green Belt), 34 (Highways Consideration in Development Control), 35 (Highway Improvements in Association with Development), 69 (General Design and Layout), 74 (Landscaping and Tree Preservation), 91 (Location of Leisure Facilities), 97 (Existing Footpaths, Bridleways and Cycleways), 104 (Landscape Conservation) and 111 (Archaeological Sites Where Planning Permissions may be Subject to a Recording Condition) of the St Albans District Local Plan Review 1994.   Note: Annette Stuart, who had given notice, spoke against the above application.  Alistair Crosby, representing the Hertfordshire Woodland Trust, had not given notice but was invited by the Chair to address the meeting and answer Members’ questions. </div> </div> </td> </tr> <tr> <td class="mgItemNumberCell"><a name="AI7119"></a>5.</td> <td> <a href="mgConvert2PDF.aspx?ID=7895" title="Link to document '5/2010/1022 -
