This is in order to achieve the EU Waste Framework Directive (WFD) and the EU Landfill Directive (LFD) and to close the gap between the current recycling rate and the 2020 EU WFD target of 50%.  Depending upon the nature of these initiatives, they could have a considerable impact on the residual waste which the Council is predicted to produce.         The Committee is aware that arc21 is currently procuring a suitable contractor to operate both Mechanical/Biological Treatment (MBT) and Energy from Waste/Incinerator (EfW) facilities to treat the remaining residual waste cannot to be sent for recycling or composting.  As part of this procurement process, the Council now will have to declare what its guaranteed minimum tonnages will be to be sent for treatment to these facilities in future years.  Following comprehensive modelling and consideration between arc21 and its constituent councils, it has been determined that, subject to the introduction of new recycling and composting initiatives, each council should be prepared to commit 80% of its forecasted residual waste.         This report, therefore, sets out to determine the proposed guaranteed minimum tonnage which the Council will commit to the arc21 residual waste project.   Key Issues   Residual waste treatment tender and minimum guaranteed tonnage   Members will be aware that, in line with the 2006 Waste Plan, arc21 is conducting a procurement exercise, using the EU’s Competitive Dialogue procedure, to appoint a contractor to develop and operate appropriate facilities to treat the remaining residual waste not being sent for recycling or composting.    The Competitive Dialogue procedure consists of a number of phases and, as part of the present ‘Invitation to Submit Detailed Solutions’ restricted</a></li> </ul> Minutes: <div class="mgWordPara"><div class="Section1">             The Head of Waste Management reminded the Members that the Council had been working with arc21 in order to implement a Waste Management Plan.  He reported that that process was now at an advanced stage and that it was focusing currently on arc21 appointing a suitable contractor to operate both mechanical biological treatment and energy from waste facilities to treat the remaining residual waste which was not being sent for composting or recycling.  He reported that a procurement process, using the European Union’s Competitive Dialogue procedure, was underway and that the technologies procured within the contract would be utilised to divert further waste from landfill in order to ensure that the Council was not liable to financial penalties.  Since the commencement in February, 2008, of that process, a number of selection stages had been undertaken, with the result that only two contractors now remained.  It was anticipated that the process would be concluded in 2011, with a contract commencing formally in April, 2012.               He informed the Members that a proposal had been received from one of the potential contractors to enter into an arrangement with the Council to use its Dargan Road Waste Transfer Station as an interim solution until the permanent mechanical biological treatment and energy from waste facilities were operational, in line with the arc21 Waste Plan.  The Waste Transfer Station would be used to accumulate waste primarily for disposal elsewhere.  He stated that discussions had now been held with the contractor, during which it had been requested that the Council draft a Heads of Agreement document governing the use of the Waste Transfer Station for the transfer, from 2012 onwards, of 75,000 tonnes per annum of residual waste.  The company had requested also that the existing staff within the facility be retained and that it be operated in line with the arrangements in place currently.  It was proposed that the contract be established for three years, with an option to renew annually thereafter for a further three years.                He reported that the Legal Services Section, together with the Council’s Project Management and Estates Unit, had been consulted and had advised that the most appropriate arrangement would be for the Council to grant to the company, should it be successful in winning the contract, a licence to occupy the Waste Transfer Station, with the Heads of Agreement document specifying the main terms to be included in a licence agreement, such as:   ·         the duration of the contract;   ·         the contractor’s occupation and use rights governing the facility;   ·         the licence fee, including the Council’s right to revise this sum;   ·         the prohibiting of sub-letting or assignment of the premises to third parties; and   ·         the Council’s right to enter into similar conditional arrangements with other parties.               He pointed out that the granting of the licence to the operator, from which the Council would obtain an annual fee, would be informed the Members that the Association for Public Service Excellence would be holding its annual seminar and awards ceremony in Londonderry on 8th and 9th September.  The theme of this year’s conference would be “Armageddon or Managed Transformation: Where to Next for Local Government’s Front Line?” and that it would explore how Local Government sustained excellence in service delivery during the current period of financial constraints.               He reported that the Association for Public Service Excellence awards scheme, which had been taking place for more than ten years, provided local authorities with an opportunity to gain recognition for their work in terms of service delivery.  He pointed out that the Waste Management Service had, in 2009, been shortlisted by the Association in the “Best Service Team - Waste Management and Recycling Service” category, having just obtained a number of international standards in relation to health and safety management, environmental management and quality management.  Whilst the Service had been unsuccessful on that occasion, it had, however, been awarded a certificate in recognition of its achievement in being shortlisted as a national finalist.               The Head of Waste Management reminded the Committee that, at its meeting on 4th August, it had granted approval for the Chairman and the Director of Health and Environmental Services (or their nominees) to attend the Association for Public Service Excellence annual seminar and awards ceremony.  He explained that, since that meeting, the Service had been advised that it had, as in 2009, been shortlisted in the “Best Service Team – Waste Management and Recycling” category and had been invited to attend the seminar and awards dinner.  He suggested that, in his capacity as Head of Waste Management and as president of the Local Government Technical Advisors’ Group, it would be beneficial for him to attend in order to engage in discussions and to raise the profile of both the Council and the Advisors’ Group.  He suggested also that an officer from the Waste Management Service be authorised to attend the awards dinner.  He pointed out that the total cost per delegate for attendance at the event would be £450, however, a complimentary place had been made available by another Service which would be used by the Waste class="mgWordPara"><div class="Section1">             The Committee considered the undernoted report:   “Relevant Background Information         Members will be aware that the Council provides two distinct recycling collection services, a two or three bin collection service in the outer areas of Belfast where residual, compostable and recyclable items are lifted on fortnightly basis and a recycling box collection service in the inner city which is delivered weekly.  These services have been in place since 2005.  The majority of these collection services are provided in-house, except for the box collection service which is provided under contract by Bryson House: the contract expires in December, 2011.         The EU Landfill (LFD) and Waste Framework Directives (WFD) have set waste diversion and recycling targets which the Council has to meet now and over the next decade.  The Department of the Environment (DoE) introduced the Northern Ireland Landfill Allowances Scheme (NILAS) in order to translate the targets contained within the LFD into progressively reducing annual limits for the amount of biodegradable waste which each council could send to landfill, up until 2020.  The Waste Management Service has been working with arc21 to secure new waste treatment and disposal operations, and with Cleansing Services to revise the Council’s waste collection arrangements to meet these challenging targets.          As part of the drive to increase the amount of waste diverted from landfill and to improve the Council’s recycling rate, particularly in light of the delays with the provision of the arc21 waste treatment infrastructure and the risk of severe penalties for failure to meet targets, approval was granted to introduce a kitchen waste collection service in the city, which includes:   ·         The collection of kitchen waste in brown bins from 60,000 households; and   ·         Two pilots with a number of houses on the recycling box service which covers almost 10,000 households.  The two pilots use different collection systems which have run concurrently for comparative purposes and in order to identify the most practicable and cost effective way to divert this material from landfill, i.e:    §         The collection of kitchen waste separately through a dedicated service provided by the Council’s Cleansing Service to 7,000 households; and   §         A combined kitchen waste/recycling box collection service by Bryson House from just over 2000 households.         The initial pilot kitchen waste collection service in Belfast was designed to test the capture of such waste from households which would not have access to a brown bin and, as such, the initial trial was specifically designed to complement the box scheme in the inner city.  Since its launch in June 2008, the initial pilot has been delivered by the Council’s Cleansing Services and has involved some 7,000 households from a range of different house types.  The kitchen waste is collected using a dedicated collection vehicle on the same day as the recyclables collected in the box by Bryson House.  From the outset of the pilot, both the kitchen waste container and box were that the arc21 Joint Committee acted on behalf of its eleven constituent councils in order to procure services in support of the implementation of the arc21 Waste Plan.  He reported that, in May, 2007, the Joint Committee had approved the award of a contract for the provision of a service for the haulage of municipal waste and dry recyclables from the Council’s Waste Transfer Station to procured landfill sites.  The contract had commenced in November, 2007, in line with the opening of the Waste Transfer Station at Dargan Road, and had been extended subsequently until 31st October, 2010.               He reported that the arc21 interim Residual Waste Treatment Contract, which was scheduled to commence in April, 2012, incorporated the haulage of residual waste from the Council’s Waste Transfer Station to treatment facilities and landfill sites.  However, during the intervening period, it would be necessary to establish a haulage contract to enable the Council to continue its operations at the Waste Transfer Station.  Consequently, arc21 had initiated in February, 2010, a tender exercise for the provision of that service.  Of the three submissions which had been received, two had been accepted and these had been subjected to a full evaluation by an arc21 tender panel, including officers from constituent Councils, in terms of cost and technical issues.  He stated that Lisburn Envirocare Limited had attained the highest overall score and that it provided also the lowest cost option.  In view of this, the arc21 Joint Committee, would, on 26th August, be recommended to award the contract to that company until March, 2012, with the option to extend for up to twelve months thereafter.  Accordingly, he recommended that the Committee agree to award the contract to
