 The application which sought  a new premises licence for a Bavarian-themed family-friendly restaurant and bar adjacent to the riverfront, was not considered at the meeting. 

 

The Sub-Committee RESOLVED to adjourn this application to a meeting to be held at 10am on Friday 19 June 2009, as the applicant was not able to attend the meeting.

APPLICATION TO VARY A LICENCE UNDER LICENSING ACT 2003

 The application before the Sub-Committee sought to vary the current licence by extending by one hour the terminal hour for licensable activities (from 2.00am to 3.00am) and the closure time by one hour (from 2.30am to 3.30am).

 

The Sub-Committee considered late material which was tabled at the meeting (attached as an Annex 1 to these Minutes) comprising:

i)                    28 additional conditions which had been agreed with the applicant; and

ii)                   comments from the applicant addressing the objections raised.

 

The Licensing Officer and Legal Officer advised the Committee about objectors who were to have addressed the meeting.  The Licensing Officer advised that Heather Martin had withdrawn her representation to the Sub-Committee, as had Mrs Davies.    The other objector who was to address the Sub-Committee, Mr Davies (both in respect of his own representations and as one of the Directors of Becketts Place Residents Association) did not attend the meeting. The Legal Officer advised that the petition of the Marina Place Residents was not valid and, on being challenged by the Applicant’s agent, confirmed that the representation from Becketts Place Residents Association was valid.

The Sub Committee considered the written representations, and oral representations from the applicant’s representatives, and having regard to the Council’s Licensing Policy, National Guidance and whether the licensing objectives were met, in particular those relating to the prevention of crime and disorder and prevention of public nuisance, the Sub-Committee

 

RESOLVED:

 

1.      To permit the extension by one hour of the terminal hour for licensable activities (from 2.00am to 3.00am) and the closure time by one hour (from 2.30am to 3.30am)

 

2.      To note all the conditions as set out in Annex 1 to these Minutes, which had been agreed by the Applicant with the Police and the Environmental Health Noise Team respectively.

GOALS SOCCER CENTRE, KINGSTON ROAD, TOLWORTH PDF 51 KB

APPLICATION FOR LICENCE UNDER LICENSING ACT 2003

 The application before the Sub-Committee sought a new premises licence for a new purpose built changing and social facility for the Goals Soccer Centre which facility has been built on the site of and replaces the previous Decca Sports Club which held a Club Certificate.

 

The Sub-Committee considered late material which was tabled at the meeting (attached as an Annex 2 to these Minutes) comprising:

i)                    a letter from the Goals Soccer Centre Operations Director dated 15 May;

ii)                   draft conditions which had been agreed with the applicant

iii)                 background correspondence:

- a letter of 12 May from RBK about noise complaints received and

- a letter of 7 May from the DPS of Goals Soccer Centres responding to the objector to the licence.

 

Paragraph 6 of the report was corrected to read ‘The premises are situated on The Kingston Road opposite Tolworth Rail Station…’

The Sub Committee considered the written representations, and oral representations from the objector and applicant’s representatives, and having regard to the Council’s Licensing Policy, National Guidance and whether the licensing objectives were met, in particular those relating to the prevention of public nuisance and the prevention of crime and disorder, the Sub-Committee

 

RESOLVED:

 

To permit:

 

1.      the licensed area to be open between the hours of 09.00 and 23.30 Sunday to Thursday and to 00.30 Friday and Saturday and for the following activities:

 

a)      Recorded music 10.00 to 23.00 Sunday to Thursday and 10.00 to 00.00 Friday and Saturday

b)      Late night refreshment: 23.00 to 00 Friday and Saturday

c)      Facilities for dancing 10.00 to 23.00 Sunday to Thursday and 10.00 to 00.00 Friday and Saturday

 

2.      To note the conditions below which had been agreed by the Applicant with the Police and the Environmental Health Noise Team respectively:

 

a)      No 18th birthday parties shall be allowed at the premises.

b)      After 10pm, apart from for access, egress and in case of emergency, all doors and windows will be kept closed.

c)      Clearly legible notices shall be displayed at all exits from the premises requesting patrons to respect the needs of local residents and to leave the premises and area quietly.

d)      A dedicated telephone number of the Designated Premises Supervisor for use by any person who may wish to make a complaint during the operation of the licence, which shall be provided to the local residents association.

e)      No rubbish including bottles will be placed in outside areas between 11pm and 8am.
