\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\nHe advised the Members that when an application for an Amusement\nPermit was made the applicant was required to state the proposed\ndays and hours of opening for information purposes.\u00c2\u00a0 However, under the terms of the\nBetting, Gaming, Lotteries and Amusements (Northern Ireland) Order\n1985 there was no express provision to control the opening hours of\nthe amusement arcades premises on Sunday or any other day of the\nweek.\u00c2\u00a0 He advised the\nMembers further that under Article 118 of the Order, the Council\ncould require arcades to close early but, in any case, not earlier\nthan 10.00\u00c2\u00a0p.m. and could only impose that requirement under\ncertain conditions.

\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\nThe Head of Building Control then submitted for the information of\nthe Members details of the opening hours of twenty-two arcade\npremises operating currently throughout the City, giving details of\nthe opening hours specified on the application forms.\u00c2\u00a0 In addition, he had included the\nresults of a telephone survey which had determined the actual\nopening hours of the premises.\u00c2\u00a0 He pointed out that five arcades\nhad indicated that they did not open on Sunday and, of the\nremaining seventeen, six did not open until noon or later and all\nbut four were closed by midnight or earlier.\u00c2\u00a0 Those\u00c2\u00a0which opened the latest\nwere situated primarily within the City centre.

\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\nThe Head of Building Control advised the Committee that on 30th\nJanuary the Council had successfully obtained an interim injunction\nin the High Court which had prohibited entertainment on or within\nany part of Whites Tavern due to three separate breaches of\nentertainment licensing conditions which had occurred in June 2008,\nOctober 2008, and January 2009.\u00c2\u00a0 He had reported that the applicant\nhad pleaded guilty in the Court on 9th December for offences which\nhad occurred in June and had been due to appear before the\nMagistrates Court on 21st April in relation to the other\noffences.\u00c2\u00a0 However, at\nthat time, the Court had agreed to adjourn and no decision had been\narrived at.

\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\nThe Committee was reminded that, at its meeting on 5th February, it\nhad agreed to suspend the Seven-Day Annual Entertainments Licence\nin respect of Whites Tavern, 2-4 Winecellar Entry on the grounds\nthat it appeared to the Council that the provision of any\nentertainment at those premises would be likely to cause a serious\nthreat to public safety.

      Section 9\nof the Act sets out discretionary grounds under which a district\ncouncil may refuse to grant an application.  There is a right of appeal to the\nMagistrate’s Court against any refusal on these grounds.

      Both\napplicants have been invited to appear before Committee and make a\nbrief presentation regarding their proposals and to answer any\nquestions you may have. Renewal of Licensing Application for Whites Tavern, 2-4 Winecellar Entry

           \nThe Head of Building Control advised the Committee that on 30th\nJanuary the Council had successfully obtained an interim injunction\nin the High Court which had prohibited entertainment on or within\nany part of Whites Tavern due to three separate breaches of\nentertainment licensing conditions which had occurred in June 2008,\nOctober 2008, and January 2009.  He had reported that the applicant\nhad pleaded guilty in the Court on 9th December for offences which\nhad occurred in June and had been due to appear before the\nMagistrates Court on 21st April in relation to the other\noffences.  However, at\nthat time, the Court had agreed to adjourn and no decision had been\narrived at.

\n

 

\n

           \nThe Committee was reminded that, at its meeting on 5th February, it\nhad agreed to suspend the Seven-Day Annual Entertainments Licence\nin respect of Whites Tavern, 2-4 Winecellar Entry on the grounds\nthat it appeared to the Council that the provision of any\nentertainment at those premises would be likely to cause a serious\nthreat to public safety.

\n

 

\n

           \nThe Committee was advised that the applicant Mr. Nixon had not\navailed of his right of appeal against the decision to suspend his\nLicence and entertainment had not been provided at the premises\nsince 5th February. However, the application was now due for\nrenewal and the matter was before the Committee for\nconsideration.

\n

 

\n

           \nAccordingly, the Head of Building Control recommended that the\nCommittee defer consideration of the matter until such times as the\nCourt has made a determination in regard to the offences relating\nto the breaches of entertainment licensing conditions.

\n

 

\n

           \nThe Committee adopted the recommendations.

\n

“Relevant Background Information

\n

 

\n

      From\nJanuary 2009 there have been ongoing police investigations into the\nMynt premises and during that time\nundercover officers have been able to purchase what are believed to\nbe controlled drugs from a number of individuals at the\npremises.

\n

 

\n

      On 16th\nApril the Police Service of Northern Ireland visited the premises and as a result of\na search recovered material that would suggest that drug use is\nprevalent within the club and not restricted to one area within the\npremises.  An affidavit\nfrom a police officer indicates:

\n

 

\n

\n\n·        \nThere is clear evidence of the\nready availability of class A controlled drugs;

\n

 

\n

\n\n·        \nThere is clear evidence of the\nconsumption of class A and B controlled drugs within the premises;\nand

\n

 

\n

\n\n·        \nThere is also clear evidence\nthat liquor licensing laws are being flouted as undercover police\nofficers were able to purchase alcohol after hours in the bars from\nstaff.

\n

 

\n

\n     \nPolice also found 42 suspected ecstasy tablets in the safe of the\npremises, roughly half of which the licensee, Mr Lawrence\nBannon, has advised the police in\ninterview were seized by staff 7 months ago and the other half were\nseized by staff on 9 April 2009. Mr Bannon has also told the police that it was his\nintention to hand this material to them.

\n

\n 

\n

\n     \nMembers may be aware that six persons were arrested and\nsubsequently charged to court in connection with the police\noperation.

\n

\n 

\n

\n     \nIn light of these findings the PSNI considered that there was a\npotentially serious threat to public safety arising from the\ncontinued operation of these premises and requested that the\nCouncil acted immediately to prevent further entertainment taking\nplace.

\n

\n 

\n

      As a result\nthe Council sought an injunction in the High Court to prohibit\nentertainment on or within any part of the premises on\nFriday 17th April\n2009. However, as the\napplication was unable to be lodged until late on Friday afternoon\nand the court was in Easter recess we were unsuccessful in\nobtaining the injunction due to the unavailability of a Judge to\nhear the application.

\n

\n 

\n

\n     \nWhilst unable to obtain an injunction the Council were given\nwritten assurances that the Licensee, Mr Bannon, would adhere to a number of conditions\nuntil the Licensing Committee could meet to consider the suspension\nof the entertainments licence.  The conditions were that the\napplicant would:

\n

\n 

\n

\n\n·        \nComply with the Licensing (NI)\nOrder 1996;

\n

 

\n

\n\n·        \nNot serve or permit the\nconsumption of alcohol within the VIP section of the\npremises;

\n

\n 

\n

\n\n·        \nEnsure that all patrons\nentering the premises undergo a search;

\n

 

\n

\n\n·        \nEnsure any controlled drugs\nfound on the premises were seized and provided to the PSNI together\nwith any CCTV footage relating to the seizure of the drugs;\nand

\n

 

\n

\n\n·        \nAgree that if these conditions\nwere not met the Council would re-apply for an injunction prior to\nthe Licensing Committee meeting on the 22nd April.
