NOTED that the draft response to the\nconsultation on Regulated Entertainment (Min.397 (3) refers) had\nbeen amended as requested following the last meeting.\u00a0 A copy of the amended response had\nbeen provided for the Chairman. \u00a0Whilst officers recognised the\nrequest for this to have been sent to all members of the Committee,\nthe chairman advised that he had been comfortable all of the points\nraised at the last meeting had been covered.

RECEIVED a report from the Director of\nEnvironment (No.187) outlining the response to the borough wide\npublic consultation that had been undertaken on proposals within\nthe Licensing Policy Statement.\u00a0 The process followed on from the\nupdate provided for the Licensing Committee on 7 November 2011.

\n

NOTED

\n

\n1.\u00a0\u00a0\u00a0\u00a0\u00a0 The\nconsultation period had run from 14 October 2011 to 13 January 2012\nand had involved 995 consultation letters and emails being sent out\nto Licensed Premises, Residents Associations, Responsible\nAuthorities and Members.

\n

\n2.\u00a0\u00a0\u00a0\u00a0\u00a0 The\nconsultation had been focussed on the following licensing policy\nproposals:

\n

\na.\u00a0\u00a0\u00a0\u00a0\u00a0\nIntroduction of a Cumulative Impact Policy for Edmonton, Enfield\nHighway, Enfield Town & Southgate, as detailed in section 3.1.1\nof the report;

\n

\nb.\u00a0\u00a0\u00a0\u00a0\u00a0 Sexual\nEntertainment Venues - Preventing businesses being granted an\nautomatic right to provide \u201clive displays or performances\ninvolving nudity\u201d on up to 11 separate occasions a year\nwithout a licence;

\n

\nc.\u00a0\u00a0\u00a0\u00a0\u00a0\nIntroduction of a policy to cover licensable events taking place\nduring the Olympic & Paralympic Games between June and\nSeptember 2012;

\n

\n3.\u00a0\u00a0\u00a0\u00a0\u00a0 A total of\n8 responses had been received to the consultation (representing a\n0.8% return).\u00a0 A table\nhad been provided as Appendix 1 of the report detailing the\nresponses made, with a majority of responses (over 50% in each\ncase) being supportive of the 3 licensing proposals.

\n

\n4.\u00a0\u00a0\u00a0\u00a0\u00a0 A total of\n4 comments (as detailed in Appendix 2 of the report) had been\nreceived in respect of the 3 licensing proposals, none of which\ncontained any policy or legal implications.

\n

\n5.\u00a0\u00a0\u00a0\u00a0\u00a0 In response\nto comments by members of the Committee it was confirmed that:

\n

\na.\u00a0\u00a0\u00a0\u00a0\u00a0 the\nCumulative Impact Policy did not represent a blanket refusal\npolicy, with each application in the areas covered still needing to\nbe assessed and considered on its own merits;

\n

\nb.\u00a0\u00a0\u00a0\u00a0\u00a0 subject to\napproval by the Committee, the 3 proposals would need to be\nrecommended on to Council for formal approval on 28 March 2012 with\na view to the new policy proposals becoming effective from 1 April\n2012.\u00a0 Current and new\napplicants would be advised that the new policy would apply\n(subject to agreement by Council) to consideration of any\noutstanding or new applications with effect from the 1 April\n2012.\u00a0 The new policy\nwould not apply to existing licences, unless these became subject\nto review on or after 1 April 2012.
