\n(a) \nCouncillor Lee announced that the Council’s proposed budget\nfor 2009/10 was now out for public consultation and he was looking\nforward to receiving the views and comments of the\npublic. There had been\ngood press coverage including an item on BBC News South East.
\n\n
(b) \nCouncillor Law announced that the recent Hot Topix youth conference\nhad been a huge success with 98 young people attending over the two\ndays. They had been\nconsulted on how they could engage in the new Local\nChildren’s Services Partnerships and had carried out a budget\nexercise to prioritise how they would spend Council budgets and\nwhat they would do with £5000 in their\ncommunities. A short\nvideo of the conference was being put together for the\nMembers’ Briefing in February.
\n\n
(c) \nCouncillor Law announced that plans were in place to update the\nnotbored.net website by brightening it up and including more\nanimation and interactive elements as this had been requested by\nyoung people. The\ndesign process would involve close working with the members of a\nyouth action group to get their views and involve them as much as\npossible in delivery of the project.
\n\n
(d) \nCouncillor Law announced that a new Intergenerational Project was\nbeing planned that would run with the Spring Lane neighbourhood\ncentre team to deliver a joint cooking project with older residents\nand young people from the positive image action group taking\npart.
\n\n
(e) \nCouncillor Samper announced that the Council’s Street Trading\nBill was making its way through the House of Commons. She thanked the Head of Legal and\nDemocratic Services and all the other officers involved who had\nhelped in preparing the evidence in order to achieve a smooth\npassage of the Bill.
\n\n
(f) \nCouncillor Pickersgill announced that the Council had had a\nsuccessful day at auction recently and had sold a property in\nSturry Road for a price above the reserve. The funds from the sale would\nhelp towards the financing of some of the larger capital projects\ncurrently being undertaken by the Council.
\n\n
(g) \nCouncillor Vickery-Jones announced that he had recently attended a\nDiversity and Equality Forum. Some interesting talks had been\ngiven and he had had the opportunity to speak with a number of\npeople. A number of\nissues had arisen and he would be following them up in the near\nfuture.
\n\n
(h) \nCouncillor Austin announced that he attended the party held at\nWindsor House in Whitstable on 15 October to celebrate the\n40th anniversary of the building, originally erected by\nthe old Whitstable Urban District Council in 1968. Many of the residents enjoyed the\nparty that had been addressed by the Lord Mayor with appropriate\nmusical entertainment being provided after the\nrefreshments. The\nCouncil was currently finishing kitchen replacements and a number\nof residents had expressed great satisfaction. In addition there would be window\nreplacements and bathroom upgrades for those not already\ndone. \nA petition by the Chair of Thanington\nResidents Association along with a list of 2000+ signatories to the\nPetition had been presented to the meeting of the Council held on 2\nOctober 2008. The\nCouncil had referred it to the Executive.

Councillor Eden-Green as a Ward Member spoke\nand set out his reasons for supporting the petition. He also reminded the Executive\nMembers that he was a trustee of the Thanington Resource\nCentre.
\n\n
Members recognised that valid points had been\nmade in the petition and by the speakers at the meeting but as a\nconsultant’s report on the options for extending park and\nride provision in the city was due to be completed in the near\nfuture, it was felt that, in order to make an informed decision,\nofficers should prepare a full report once the consultant’s\nreport was received. \nThe reports will then be considered at a future meeting.

RESOLVED –
\n\n
(a) That\nthe petition be received with interest and the residents’\nconcerns noted.
\n\n
(b) That,\nfollowing receipt of the consultant’s report on the options\nfor extending park and ride provision in the city, the Head of\nTransportation and Engineering prepare a full report on all the\nissues contained within the petition for consideration at a future\nmeeting of the Executive.

(c) \nThat the decision at (a) be reviewed if a proposal is made that\nmight benefit from a concerted approach with other Kent local\nauthorities possibly linked to priorities in Kent Agreement 2.

\nThe portfolio holder presented the report of\nthe Director of Corporate Services that explained that the\nCouncil’s Procurement and Partnering Strategy was reviewed\nannually so as to ensure that it reflected the Council’s\ncommunity and corporate plans, provided a framework for best value\nand that it stood alongside the Council’s contract standing\norders and constitution.
\n\n
RECOMMENDED (to full Council) –\nThat the Council approve and adopt the revised Procurement and\nPartnering Strategy as set out at Appendix 1 of the report as now\nsubmitted.

\nMinutes:
\nMembers of the Executive considered the report\nof the Head of Regeneration and Economic Development that set out\nthe procedure for reviewing adopted Local Plan policies through the\n“saved” policies protocol, as part of the transition to\nthe new Local Development Framework system. The report made recommendations\nregarding which of the Local Plan policies should be\n“saved” in the long term.

RECOMMENDED (to full Council)\n–

(a) That\nthe recommendations in the report as now submitted in relation to\nthe saving of the Local Plan policies be agreed.
\n\n
(b) That\nan application be submitted to the Government Office for the South\nEast based on the recommendations as agreed at (a) above.

\nThe portfolio holder introduced the joint\nreport of the Head of Regeneration and Economic Development and the\nDirector of Community Services that explained that comments had\nbeen invited by the South East England Regional Assembly (SEERA) on\nfour spatial options for the distribution of pitch requirements for\nGypsies, Travellers and Travelling Showpeople as part of the\nPartial Review of the South East Plan. Members were informed that a\nfurther option had been put forward by SEERA the previous Monday\nbut having considered it felt that option A should be the preferred\none.
\n\n
RESOLVED – That the Council respond to\nthe South East Regional Assembly consultation as set out in option\nA of the report as now submitted.
\nTO CONSIDER the report\nof the Head of Regeneration and Economic Development

\nThe portfolio holder introduced the report of\nthe Head of Regeneration and Economic Development that provided\ndetails of a European partnership of councils that aided\ndevelopment of cultural regeneration projects at a local level and\nworked together to share good practice. The partnership was bidding\nfor Interreg funds to support this work. The project budget total\nfor Canterbury was €1.798m (£1.384m sterling) with a bid\nfor the maximum rebate of 50% of this spend.
\n\n
The Council’s element of the proposed\nbid would focus on public realm work around the New Marlowe Theatre\nand the Beaney Institute. Matching funds would be drawn\nfrom the agreed capital programme together with necessary officer\ntime to deliver the public realm project to help secure funds from\nthe European Regional Development Fund.
\n\n
RESOLVED – That the funding bid made on\n30 September 2008 be approved.
\n\n
(Councillor Cragg declared a personal interest\nin this item and did not vote.)
\nThe following matter has been referred to the\nExecutive by the Overview and Scrutiny Committee:

Minute No 271\n– Request from Herne Bay Area Member Panel relating to the\nKent County Council (KCC) highway trees and grass verges\nbudget.
\n\n
The Committee\ndiscussed the letter which they had received from the Head of\nEnvironment and Street Scene relating to the current situation on\nthe above contract. \nThey made points including the following:
\n\n
i) \nGreater detail in the letter would have been appreciated.
\n\n
ii) \nWeed spraying in the district had started.
\n\n
iii)\n There\nhad been more complaints to councillors about this issue than any\nother matter.
\n\n
iv)\n The\nchange of a chemical used in the weed killer as a consequence of\nEuropean law.
\n\n
v)\n \nThe process now used by KCC for payments to the City Council was\nmore complicated.
\n\n
vi)\n A\ndispute between the two councils relating to the work which should\nbe undertaken by the City Council.
\n\n
RESOLVED\n–
\n\n
a)\n \nThat the Executive be requested to consider this matter and\nfind a solution to it.
\n\n
\nThe Head of Environment and Street Scene has\nwritten to the relevant Councillors addressing the points raised by\nthe Committee. The\nletter is attached for information.

TO NOTE
\nMinutes:
\nMembers of the Executive had before them a\nreferral from the Overview and Scrutiny Committee that requested\nthat the Executive consider the problems arising from the Kent\nCounty Council Highway’s budget for trees and grass\nverges. The Head of\nEnvironment and Street Scene had written to the Members of the\nOverview and Scrutiny Committee addressing the points raised by the\nCommittee. Members\nfelt that the letter had dealt with the points and issues contained\nwithin the relevant minute of the meeting.

Officer’s comment: All the money\nreceived from the Kentish Flats offshore wind farm development has\nbeen fully allocated. \nThere is no available money for this project from that\nsource. The estimated\ncost of the information boards is between £3000 - 4000\ndepending on size, design and construction.

\nb) \nagree that in future the wind farm will be known as the Herne Bay\nWind Farm on all council agendas.
\n\n
TO CONSIDER
\nMinutes:
\nThe Herne Bay Area Member Panel had requested\nthat the Executive approve the erection of two information boards\nalong the Herne Bay seafront. Members were advised that the\nfunds received from the Kentish Flats offshore wind farm\ndevelopment had been fully allocated and so it was unlikely that\nfunds could be found from other budgets to cover the cost of the\nboards estimated to be between £3000 and £4000\ndepending of size, design and construction. The portfolio holder advised that\nthe owner of the wind farm might be willing to pay for a board and\nsuggested that the relevant officer should make suitable\nenquiries.
\n\n
The Panel had also requested that the Kentish\nFlats offshore wind farm be known as the Herne Bay Wind Farm on all\nCouncil agendas. \nMembers were not convinced that the Council could simply rename the\nwind farm nor that it would be of any benefit.

RESOLVED –
\n\n
(a) That,\nsubject to there being no cost to the Council, approval be given to\nthe erection of one or two information boards along the Herne Bay\nseafront.

| \n\t\t\t\t\n\t\t | \t\t\t\n\t\t\n\t\t\t\t\t Notice of Motion - Sustainable Communities Act \n \n\n \nThe following Notice of Motion from\nCouncillors Eden-Green and M Flaherty, which incorporates an\namendment by Full Council at its meeting on 2 October 2008, has\nbeen referred to the Executive by the Council for\nconsideration: - \n\n 'This Council\nrecommends to the Executive, in considering the new\nSustainable Communities Act, that it opts into the process subject\nto a report by Officers into the legal and financial implications\nof accepting this Act, when invited by the Government to do so\nlater this month.' \n\n TO CONSIDER in\nconjunction with the report of the Head of Policy and\nImprovement. \nMinutes: \n\n \n\t\t\t\t\t\n \nThe Council, at its meeting on 2 October 2008,\nhad referred the following Notice of Motion from Councillor\nEden-Green and M Flaherty to the Executive for consideration: \n\n “This council recommends to the\nExecutive in considering the new Sustainable Communities Act, that\nit opts into the process subject to a report by officers into the\nlegal and financial implications of accepting this Act, when\ninvited by the Government to do so later this month”. \n\n Councillor Eden-Green, as the proposer of the\nmotion, spoke on the motion and explained the purpose and reason\nfor it. \n\n Members of the Executive discussed the motion\nand considered the report of the Head of Policy and Improvement\nthat provided background information the Sustainable Communities\nAct. \n\n RESOLVED – \n\n (a) That\nthe Council take no action at the present time to opt in to the\nprocess for the Sustainable Communities Act. \n\n (b) That\nthe decision at (a) be reviewed if relevant issues are identified\nin the coming months that result in a proposal being developed\ninvolving Members addressing issues of significant local\nconcern. \n\n (c) \nThat the decision at (a) be reviewed if a proposal is made that\nmight benefit from a concerted approach with other Kent local\nauthorities possibly linked to priorities in Kent Agreement 2. \n | \n\t\t

Minutes: \n\n \n\t\t\t\t\t\n \nThe portfolio holder presented the report of\nthe Director of Corporate Services that explained that the\nCouncil’s Procurement and Partnering Strategy was reviewed\nannually so as to ensure that it reflected the Council’s\ncommunity and corporate plans, provided a framework for best value\nand that it stood alongside the Council’s contract standing\norders and constitution. \n\n RECOMMENDED (to full Council) –\nThat the Council approve and adopt the revised Procurement and\nPartnering Strategy as set out at Appendix 1 of the report as now\nsubmitted. \n | \n\t\t
| \n\t\t\t\t\n\t\t | \t\t\t\n\t\t\n\t\t\t\t\t Local Plan \"saved\" policies procedure \n \n\n \nTO CONSIDER the report of the Head of\nRegeneration and Economic Development \nMinutes: \n\n \n\t\t\t\t\t\n \nMembers of the Executive considered the report\nof the Head of Regeneration and Economic Development that set out\nthe procedure for reviewing adopted Local Plan policies through the\n“saved” policies protocol, as part of the transition to\nthe new Local Development Framework system. The report made recommendations\nregarding which of the Local Plan policies should be\n“saved” in the long term. \n\n RECOMMENDED (to full Council)\n– \n\n (a) That\nthe recommendations in the report as now submitted in relation to\nthe saving of the Local Plan policies be agreed. \n\n (b) That\nan application be submitted to the Government Office for the South\nEast based on the recommendations as agreed at (a) above. \n\n (c) \nThat the proposal to remove the leisure/tourism allocation at the\nnorthern end of Memorial Park, Herne Bay be agreed. \n | \n\t\t
| \n\t\t\t\t\n\t\t | \t\t\t\n\t\t\n\t\t\t\t\t Public consultation on partial review of draft South east Plan - Gypsies and Travellers \n \n\n \nTO CONSIDER the report of the Head of\nRegeneration and Economic Development. \nMinutes: \n\n \n\t\t\t\t\t\n \nThe portfolio holder introduced the joint\nreport of the Head of Regeneration and Economic Development and the\nDirector of Community Services that explained that comments had\nbeen invited by the South East England Regional Assembly (SEERA) on\nfour spatial options for the distribution of pitch requirements for\nGypsies, Travellers and Travelling Showpeople as part of the\nPartial Review of the South East Plan. Members were informed that a\nfurther option had been put forward by SEERA the previous Monday\nbut having considered it felt that option A should be the preferred\none. \n\n RESOLVED – That the Council respond to\nthe South East Regional Assembly consultation as set out in option\nA of the report as now submitted. \n | \n\t\t

Minutes: \n\n \n\t\t\t\t\t\n \nThe portfolio holder introduced the report of\nthe Head of Regeneration and Economic Development that provided\ndetails of a European partnership of councils that aided\ndevelopment of cultural regeneration projects at a local level and\nworked together to share good practice. The partnership was bidding\nfor Interreg funds to support this work. The project budget total\nfor Canterbury was €1.798m (£1.384m sterling) with a bid\nfor the maximum rebate of 50% of this spend. \n\n The Council’s element of the proposed\nbid would focus on public realm work around the New Marlowe Theatre\nand the Beaney Institute. Matching funds would be drawn\nfrom the agreed capital programme together with necessary officer\ntime to deliver the public realm project to help secure funds from\nthe European Regional Development Fund. \n\n RESOLVED – That the funding bid made on\n30 September 2008 be approved. \n\n (Councillor Cragg declared a personal interest\nin this item and did not vote.) \n | \n\t\t
| \n\t\t\t\t\n\t\t | \t\t\t\n\t\t\n\t\t\t\t\t\n\n\n \n \n\n \nThe following matter has been referred to the\nExecutive by the Overview and Scrutiny Committee: \n\n Minute No 271\n– Request from Herne Bay Area Member Panel relating to the\nKent County Council (KCC) highway trees and grass verges\nbudget. \n\n The Committee\ndiscussed the letter which they had received from the Head of\nEnvironment and Street Scene relating to the current situation on\nthe above contract. \nThey made points including the following: \n\n i) \nGreater detail in the letter would have been appreciated. \n\n ii) \nWeed spraying in the district had started. \n\n iii)\n There\nhad been more complaints to councillors about this issue than any\nother matter. \n\n iv)\n The\nchange of a chemical used in the weed killer as a consequence of\nEuropean law. \n\n v)\n \nThe process now used by KCC for payments to the City Council was\nmore complicated. \n\n vi)\n A\ndispute between the two councils relating to the work which should\nbe undertaken by the City Council. \n\n RESOLVED\n– \n\n a)\n \nThat the Executive be requested to consider this matter and\nfind a solution to it. \n\n \nThe Head of Environment and Street Scene has\nwritten to the relevant Councillors addressing the points raised by\nthe Committee. The\nletter is attached for information. \n\n TO NOTE \nMinutes: \n\n \n\t\t\t\t\t\n \nMembers of the Executive had before them a\nreferral from the Overview and Scrutiny Committee that requested\nthat the Executive consider the problems arising from the Kent\nCounty Council Highway’s budget for trees and grass\nverges. The Head of\nEnvironment and Street Scene had written to the Members of the\nOverview and Scrutiny Committee addressing the points raised by the\nCommittee. Members\nfelt that the letter had dealt with the points and issues contained\nwithin the relevant minute of the meeting. \n\n RESOLVED – That the response of the Head\nof Environment and Street Scene be noted and no further action\ntaken. \n | \n\t\t

The estimated\ncost of the information boards is between £3000 - 4000\ndepending on size, design and construction. \n\n \nb) \nagree that in future the wind farm will be known as the Herne Bay\nWind Farm on all council agendas. \n\n TO CONSIDER \nMinutes: \n\n \n\t\t\t\t\t\n \nThe Herne Bay Area Member Panel had requested\nthat the Executive approve the erection of two information boards\nalong the Herne Bay seafront. Members were advised that the\nfunds received from the Kentish Flats offshore wind farm\ndevelopment had been fully allocated and so it was unlikely that\nfunds could be found from other budgets to cover the cost of the\nboards estimated to be between £3000 and £4000\ndepending of size, design and construction. The portfolio holder advised that\nthe owner of the wind farm might be willing to pay for a board and\nsuggested that the relevant officer should make suitable\nenquiries. \n\n The Panel had also requested that the Kentish\nFlats offshore wind farm be known as the Herne Bay Wind Farm on all\nCouncil agendas. \nMembers were not convinced that the Council could simply rename the\nwind farm nor that it would be of any benefit. \n\n RESOLVED – \n\n (a) That,\nsubject to there being no cost to the Council, approval be given to\nthe erection of one or two information boards along the Herne Bay\nseafront. \n\n (b) That\nthe requests of the Herne Bay Area Member Panel for the wind farm\nto be known as the Herne Bay Wind Farm on all council agendas be\nrefused. \n | \n\t\t
