Enforcement of Planning Controls

The Panel considered the report of the Head of\nDevelopment Services on the progress of enforcement cases.

\n

  

\n

The Planning Inspectors in the Enforcement\nTeam explained the present position for each case. Details of a\nstatistical analysis of the caseload for the Enforcement Team for\nthe financial years 2005/06, 2006/07, 2007/08 and 2008/09 were\nreported to the Panel.

\n

 

\n

A Member drew attention to concerns regarding\nvarious aspects of a development at a rural site. The Officers\nadvised on the planning issues, the need for the current activities\nat the site to be monitored and for further evidence to be provided\nin order to establish whether there has been any breach of the\nplanning controls and if any enforcement action should be\ntaken.

\n

 

\n

In the light of the number of current\nenforcement cases, a Member asked, whether a more proactive\napproach could be taken by the council in giving advice to owners\nand occupiers of properties about the potential implications of any\ndevelopment on the future sale of their property. The Officers\nadvised that, where appropriate, advice was currently given on the\nmatter.

\n

 

\n

A Member drew attention to the display of\nadvertisements in telephone kiosks. The Panel Members were advised\nthat this was permitted development with the exception of telephone\nkiosks in Conservation Areas. If there were concerns about\nparticular sites, the Members were requested to provide details for\nthe Officers to look into matter.

\n

RESOLVED -

\n(a)              \nThat the report be noted.

\n

 

\n

\n(b)              \nThat the Officers look into whether there has been compliance with\nthe terms of the Section 106 Agreement for the residential\ndevelopment at the former Nunnery Fields Hospital, Canterbury.

\n

\n(c)              \nThat the Officers investigate whether there has been a breach of a\ncondition of the planning permission regarding the colour of the\nstable building at the rural site now referred to.
